Article 1 : Preamble
These general terms and conditions of sale govern the offer to download digital works from the Guide Apacheta website, accessible on www.apacheta.fr. The term « digital works » used in these general terms and conditions of sale refers to the digital files produced and offered by Guide Apacheta: guides in PDF format as well as GPS tracks in GPX and KMZ formats.
The service is reserved for individuals and adults only and cannot be used for professional purposes. Guide Apacheta may make any changes to this service that it deems necessary. The present general conditions will then be those in force on the site at the date of the order confirmation.
Article 2 : Order
To order, you must have the legal capacity to contract and be the holder of a valid personal bank card or a checkbook. You undertake to provide true and sincere information about yourself (no, first name and email address). You declare that you have read and accepted the present general terms and conditions of sale before validating your order. The validation of the order is worth acceptance of these general conditions of sale. From the validation of the payment, the order is confirmed and can no longer be cancelled or refunded. After validation of the payment, you will be able to download the digital works ordered.
We will confirm your order by email and we will send you the link allowing you to download the selected digital works. Access to the ordered digital works is only open to you on a personal basis and remains valid for a period of 180 days within the limit of 5 downloads, starting from the registration of the order.
Guide Apacheta reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order.
Article 3 : Rates
Guide Apacheta reserves the right to modify the prices of its books at any time. Books are invoiced on the basis of the rates in force at the time the order is placed. The sale is not subject to VAT.
Article 4 : Terms and conditions of payment
Online payments are made and secured by the French company Payplug. The service accepts all Visa and MasterCard credit and debit cards, both European and international, Electron (Visa) and Maestro (Maestro) cards, as well as basic French national bank cards. Upon validation of payment by credit card or cheque, you will receive an automatic transaction confirmation email from Payplug with the transaction number. For payments by cheque, the order will be validated upon receipt of the cheque.
Article 5 : Downloading files
Every validated order is confirmed by email. You will receive an automatic confirmation email detailing the order and containing links to download the digital books. These links remain valid for a period of 180 days within the limit of 5 downloads, starting from the registration of the order.
Article 6 : Right of withdrawal
The right of withdrawal is not applicable to digital products given their nature. Any order placed is firm and definitive as soon as the download links are made available.
Article 7 : Intellectual property rights
Guide Apacheta owns the copyright on the digital works offered for sale. Any reproduction of the digital works, in whole or in part, by any process or medium whatsoever, is prohibited and constitutes an infringement without the publisher’s permission. The guides and the associated GPS files are the intellectual and exclusive property of Guide Apacheta.

Article 8 : Applicable law and jurisdiction
This contract is subject to French law. In the event of a dispute concerning the interpretation and execution of its general conditions of sale, and in the absence of an amicable agreement between the parties, only the courts of Grenoble (France) will be competent to hear the dispute.
Article 9 : Personal data
In accordance with the RGPD law (General Regulation on Data Protection) of 25 May 2018, you have the right to access, modify and delete data concerning you, collected in the context of your order. To exercise this right, please send us your request via the contact form. The personal data collected are confidential, they are not sold or exchanged to outside companies..
